1. Overview

These Terms of Service (“Terms”) govern all services provided by My Product Model (“Company,” “we,” “us,” or “our”). By purchasing or using our services, you (“Client”) agree to be bound by these Terms.

2. Scope of Services

My Product Model provides custom product photography, content creation, and related creative services.

All services are based on:

  • Selected package or invoice
  • Client-submitted moodboards, references, and shot lists
  • Written communication between Client and Company

3. Creative Direction & Client Approval

By placing an order, Client confirms that all submitted creative direction, including moodboards, references, and shot lists, has been reviewed and approved.

Client acknowledges:

  • Creative services are inherently subjective
  • Final deliverables will align reasonably—not exactly—with references
  • Variations in styling, lighting, composition, props, backgrounds, and artistic interpretation are normal

Subjective dissatisfaction does not constitute non-delivery or service failure.

4. Deliverables

Deliverables are limited strictly to:

  • The number of final edited images included in the purchased package or invoice
  • The specific concepts explicitly listed in the approved shot list

Unless expressly agreed in writing:

  • Bundle shots, product groupings, or specific compositions are not guaranteed
  • Alternate variations or additional angles are not included

5. Production Timeline

All timelines are estimates and may vary based on project complexity, studio schedule, product arrival timing, and Client responsiveness.

6. Revisions & Reshoots

If a deliverable materially deviates from the approved shot list, as opposed to reflecting subjective preference, Company may, at its discretion:

  • Make reasonable edits
  • Offer a limited reshoot
  • Provide a partial credit or refund

Any remedy offered under this section is the sole and exclusive remedy for that material deviation.

7. Payment Terms

  • Full payment is required before production begins
  • All sales are final once production has started

8. Refund Policy

Because services are custom and creative in nature:

  • All sales are final once production begins
  • No refunds will be issued for aesthetic preference, branding alignment, styling, or creative direction

If a specific contracted deliverable is not provided as agreed in the approved scope, any refund or credit will be limited strictly to that deliverable’s value.

9. Acceptance of Work

Client must review delivered assets within five (5) business days after delivery and provide written notice identifying any missing contracted deliverable.

If no written notice of a missing contracted deliverable is received within that period, the project is deemed accepted in full, subject to rights that cannot lawfully be waived.

10. Product Shipping & Returns

Client is responsible for shipping products to My Product Model. Return shipping is not included unless agreed in writing.

Products that remain reasonably returnable may be returned only when Client provides a prepaid return label within fourteen (14) days after final delivery.

Products that are consumed, emptied, materially altered, or damaged during production may not be returnable. If no prepaid return label is provided within fourteen (14) days after final delivery, Company may retain, donate, recycle, or dispose of the product after providing notice, where permitted by law.

Client assumes all risk of loss or damage in transit to and from Company.

11. Intellectual Property

  • Company retains ownership of all content and raw files
  • Client receives a non-exclusive license to use final images for marketing and promotional purposes after full payment

Company may use images for portfolio and promotional purposes.

12. Chargebacks & Disputes

Client agrees to contact Company first and allow a reasonable opportunity to investigate and attempt good-faith resolution of any concern. This provision does not waive or limit any rights available under applicable law or card-network rules.

13. Limitation of Liability

Total liability shall not exceed the amount paid for the specific service giving rise to the claim.

14. Force Majeure

Company is not liable for delays or failure to perform due to circumstances beyond reasonable control, including natural disasters, supply chain disruptions, carrier delays, illness, or emergencies.

15. Governing Law

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.

16. Updates to Terms

My Product Model reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
