1. Overview

These Terms of Service (“Terms”) govern all services provided by My Product Model (“Company,” “we,” “us,” or “our”). By purchasing or using our services, you (“Client”) agree to be bound by these Terms.

2. Scope of Services

My Product Model provides custom product photography, content creation, and related creative services.

All services are based on:

  • Selected package or invoice
  • Client-submitted moodboards, references, and shot lists
  • Written communication between Client and Company

3. Creative Direction & Client Approval

By placing an order, Client confirms that all submitted creative direction, including moodboards, references, and shot lists, has been reviewed and approved.

Client acknowledges:

  • Creative services are inherently subjective
  • Final deliverables will align reasonably—not exactly—with references
  • Variations in styling, lighting, composition, props, backgrounds, and artistic interpretation are normal

Subjective dissatisfaction does not constitute non-delivery or service failure.

4. Deliverables

Deliverables are limited strictly to:

  • The number of final edited images included in the purchased package or invoice
  • The specific concepts explicitly listed in the approved shot list

Unless expressly agreed in writing:

  • Bundle shots, product groupings, or specific compositions are not guaranteed
  • Alternate variations or additional angles are not included

5. Production Timeline

All timelines are estimates and may vary based on project complexity, studio schedule, product arrival timing, and Client responsiveness.

6. Revisions & Reshoots

If a deliverable materially deviates from the approved shot list, as opposed to reflecting subjective preference, Company may, at its discretion:

  • Make reasonable edits
  • Offer a limited reshoot
  • Provide a partial credit or refund

Any remedy offered under this section is the sole and exclusive remedy for that material deviation.

7. Payment Terms

  • Full payment is required before production begins
  • All sales are final once production has started

8. Refund Policy

Because services are custom and creative in nature:

  • All sales are final once production begins
  • No refunds will be issued for aesthetic preference, branding alignment, styling, or creative direction

If a specific contracted deliverable is not provided as agreed in the approved scope, any refund or credit will be limited strictly to that deliverable’s value.

9. Acceptance of Work

Client must review delivered assets within five (5) business days after delivery and provide written notice identifying any missing contracted deliverable.

If no written notice of a missing contracted deliverable is received within that period, the project is deemed accepted in full, subject to rights that cannot lawfully be waived.

10. Product Shipping & Returns

Client is responsible for shipping products to My Product Model. Return shipping is not included unless agreed in writing.

Products that remain reasonably returnable may be returned only when Client provides a prepaid return label within fourteen (14) days after final delivery.

Products that are consumed, emptied, materially altered, or damaged during production may not be returnable. If no prepaid return label is provided within fourteen (14) days after final delivery, Company may retain, donate, recycle, or dispose of the product after providing notice, where permitted by law.

Client assumes all risk of loss or damage in transit to and from Company.

11. Intellectual Property

  • Company retains ownership of all content and raw files
  • Client receives a non-exclusive license to use final images for marketing and promotional purposes after full payment

Company may use images for portfolio and promotional purposes.

12. Chargebacks & Disputes

Client agrees to contact Company first and allow a reasonable opportunity to investigate and attempt good-faith resolution of any concern. This provision does not waive or limit any rights available under applicable law or card-network rules.

13. Limitation of Liability

Total liability shall not exceed the amount paid for the specific service giving rise to the claim.

14. Force Majeure

Company is not liable for delays or failure to perform due to circumstances beyond reasonable control, including natural disasters, supply chain disruptions, carrier delays, illness, or emergencies.

15. Governing Law

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.

16. Updates to Terms

My Product Model reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.

17. Studio Monthly Membership

Membership supplement effective September 13, 2026; applies to new Studio monthly enrollments. Enrollment availability is shown on the Pricing page.

Membership and billing

MPM Studio Member costs $69 USD per month, charged in advance, and renews monthly until canceled. There is no free trial. This membership checkout does not add sales tax; the recurring membership charge is $69 USD. This statement applies only to this membership checkout, not other purchases.

The membership provides access to Studio member pricing and eligible benefits. It does not include a monthly allocation of photos, video clips, or production deliverables. Creative services and content are purchased separately under an approved project scope.

Member benefits and pricing

  • No studio booking fee for member shoots.
  • Photos at $49 each and video clips at $149 each.
  • 10% off eligible models, styling, and creative add-ons; packages and pass-through expenses are excluded.
  • Member asset prices are final member rates. Additional discounts or promotions cannot be stacked.

Priority scheduling is subject to availability. Product storage and deliverable details are defined in the project scope; membership does not promise unlimited storage, guaranteed production capacity, or unlimited edits.

Member pricing is locked for the agreed scope when you accept a quote while your Studio membership is active. Those accepted prices remain unchanged if membership expires before the shoot. New quotes, additional services, and scope changes require an active membership to receive member pricing. Existing accepted project commitments remain in place.

Renewal, cancellation, and refunds

Cancel through your membership billing portal before the next renewal to stop future membership charges. Cancellation takes effect at the end of your paid period, and benefits remain available until that period ends. If renewal is not paid, benefits end when the paid period expires; payment retries do not extend benefits for free.

Routine cancellation or non-use does not create a refund, prorated refund, or monetary credit for a paid membership period. Billing errors, remedies for contracted non-delivery, and rights required by applicable law remain protected.

Separate project agreements and Shop purchases

The membership fee does not satisfy a project deposit or invoice, authorize production, or change an existing agreement. Content licensing and usage rights remain governed by these Terms and your written project agreement. The existing project provisions above remain unchanged.

Memberships and services are billed through Stripe. Merchandise, digital downloads, and physical Shop products use Shopify checkout and their applicable purchase terms. Personal information is handled under our Privacy Policy.

18. Additional Membership Plans

Membership supplement effective September 13, 2026, applying to new enrollments in the plans below when offered on the Pricing page. Existing accepted agreements are unchanged. The Studio monthly terms in Section 17 continue to apply to that plan.

Plans, recurring charges, and included benefits

  • Studio Annual: $588 USD charged upfront every year, equivalent to $49 per month, not monthly installments. No studio booking fee for member shoots; final member prices of $49 per photo and $149 per video clip; 10% off eligible models, styling, and creative add-ons. No photos or clips are included in the membership fee.
  • Atelier Monthly: $199 USD charged every month. Atelier Annual: $1,788 USD charged upfront every year, equivalent to $149 per month, not monthly installments. No studio booking fee for member shoots; final member prices of $45 per photo and $139 per video clip; 15% off eligible models, styling, and creative add-ons. No photos or clips are included in the membership fee. Monthly creative planning or asynchronous brief review, priority casting, and quarterly content strategy support are scheduled within the agreed service scope.
  • Growth Partner Lite: $750 USD charged every month, including 12 edited photos per billing-anniversary month, planning support, priority scheduling, and account support within the agreed scope.
  • Growth Partner: $1,500 USD charged every month, including 25 edited photos and one edited 10–15 second product video clip in one aspect ratio per billing-anniversary month, creative direction, launch planning, and account support within the agreed scope.

All membership fees are billed in advance and renew at the stated interval until canceled. There is no free trial. These membership checkouts do not add sales tax; this describes the checkout configuration and is not a statement that all MPM products or services are tax-exempt.

Studio and Atelier asset rates are final member prices. Eligible add-on discounts do not apply to packages, pass-through expenses, sourcing goods, or the member asset rates themselves. Discounts and promotions do not stack. Growth plans waive the studio booking fee for member shoots; production beyond the included allowance, models, styling, and other extras are quoted separately, with no unspecified automatic discount.

Scheduling, casting, storage, editing, and production details are subject to availability and the written project scope. Membership does not promise unlimited production, edits, storage, or guaranteed production capacity. Content licensing remains governed by Section 11 and the applicable written project agreement; membership does not independently expand usage rights.

Growth allowances and production approval

Each Growth allowance month starts on the customer's billing anniversary. Short months use the corresponding available calendar date, returning to the original anniversary day when available. Allowances are granted only for verified paid periods. Unused content from one allowance month may be used during the immediately following allowance month, capped at one month's allocation: 12 photos for Growth Lite, or 25 photos and one clip for Growth Partner. Carried content expires at the end of that following month and cannot carry forward again. Active paid membership is required to approve new work using current or carried content.

Available content is used oldest first and deducted once when the agreed deliverables are approved for production. Approved deliverables remain owed if MPM causes a production delay; later allowance expiration does not erase the approved scope. Client cancellation or scope changes require a written adjustment and do not automatically refund or reissue allowances. Allowances cannot be exchanged for cash or used to settle an unrelated project invoice.

Included-only Growth projects carry no additional project fee for the allocated deliverables. Any separately purchased production or extras require a separate written quote and payment under the applicable project terms. Membership payment alone does not authorize an unapproved shot list or additional production.

Cancellation, failed renewal, and refunds

Use Manage membership to update payment methods, view invoices, or cancel future renewal before the next renewal. Cancellation takes effect at the end of the paid period. Annual membership cancellation stops the next annual renewal; it does not convert the annual payment into monthly installments. Self-service plan switching and membership pauses are not offered at this launch.

Benefits stop when the paid period expires if renewal is unpaid; payment retries do not extend benefits. Member-priced scope accepted while membership was active remains at its accepted price. New or additional scope needs an active membership to receive member pricing.

Billing errors, remedies for contracted non-delivery, and rights required by applicable law remain protected. This supplement does not remove existing obligations for approved deliverables.
